Terms and Conditions
Who are we?
FarmerBox BV is located in Noordwijk, and is registered with the Chamber of Commerce under number 80964338, with VAT ID NL003519657B62. FarmerBox will hereinafter be referred to as “FarmerBox” or “we”.
The word “Customer” means a person, company or other legal form with whom FarmerBox enters into an agreement regarding the sale of foodstuffs.
By “Supplier” we mean a person, company or other legal form with whom FarmerBox enters into an agreement for the supply of foodstuffs, services or other products.
Under “Custodian” is a company or other legal form with which FarmerBox enters into any agreement with regard to the management, transport and / or storage of foodstuffs.
Applicability
These General Terms and Conditions apply to all FarmerBox activities and deliveries with regard to food, other products and services around them.
These General Terms and Conditions were provided and accepted by the customer at the start of the agreement. A copy of these General Terms and Conditions can be downloaded from the FarmerBox site: www.farmerbox.nl.
Establishment of the agreement
An agreement is concluded by going through the ordering procedure, accepting the general terms and conditions and clicking the "Confirm order" button, unless otherwise agreed in advance.
FarmerBoxes
This article is about the shopping box concept in subscription form.
4.1 Entering into and Termination of Membership
The General Terms and Conditions apply to all boxes that the customer orders.
FarmerBox does not apply a cancellation period for membership, only when a box has already been ordered, it must still be purchased.
The membership agreement ends when the last box has been paid for and collected / delivered.
The customer will always receive an email confirming the termination. The customer must keep this as proof until the date of the relevant delivery has passed.
4.2 Changes
In case of change of data or an order, the customer is responsible for the correct handling thereof and always receives an e-mail for confirmation. The customer must keep this as proof until the date of the relevant delivery has passed.
Changes and cancellations can be communicated up to 7 days prior to the day of delivery. After this this is no longer possible.
4.3 Supplementary
FarmerBox reserves the right to not or no longer execute orders if previous deliveries have not been paid for.
5. Prices
Prices are in Euros.
Prices for the FarmerBox shopping boxes include VAT.
Mentioned prices are exclusive of any delivery costs.
Prices are subject to printing and typing errors.
FarmerBox reserves the right to change prices at any time. This will of course always be announced in advance.
Payment
6.1 FarmerBox Payments
In principle, the customer always pays his box in advance for individual orders. This means that a box that has not been delivered has been paid and that this amount will not be refunded. It is your responsibility to have the opportunity to receive or have your box received.
Subscription payments are made by direct debit per delivery.
If the invoice is not paid on time, FarmerBox offers the option to pay via an alternative method. Of course payment must be made before the box is taken / delivered.
If you as a customer do not meet your payment obligations, FarmerBox will use all legal means to collect the money and your subscription will be terminated.
6.2 FarmerBox Web Store
Payment of an order in the webshop is made by Ideal after completion of the order.
Delivery and transportation
7.1 FarmerBox Boxes and FarmerBox webshop
Delivery takes place when the customer picks up the box and / or delivery of the webshop order, or has it delivered to their home.
If the customer is not at home for home delivery, the box will be delivered to the neighbors. The customer will then receive a "not at home" card stating to which neighbors it has been delivered. If it is not possible to deliver the box to the neighbors, it will be taken along and a new delivery attempt will be made the following day. The customer will receive a notification about this and the option to have the box delivered during a different period or at a different address. The customer is responsible for a second delivery attempt to provide an (alternative) delivery address where the package can be delivered. It is not possible to cancel the box.
If the customer does not collect the delivery on the agreed delivery date and time, or is not at home during the first or second delivery attempt, in principle no further claims can be made on the delivery.
8. Force of the majority
Force majeure is understood to mean: any circumstance beyond FarmerBox's direct sphere of influence, as a result of which FarmerBox's compliance with the order can no longer reasonably be expected. This may include strikes, fire, extreme weather conditions, exceptional traffic jams, bus disruptions, accidents in which the products have been damaged and cannot be delivered, government measures, system or network failures and diseases and pests on the one hand, and defects in the products supplied to FarmerBox on the other hand.
FarmerBox is not liable for damage caused by force majeure as referred to in the previous paragraph on this subject.
If an overwhelming situation arises and ensures that the delivery by FarmerBox cannot be carried out, FarmerBox will inform the customer as soon as possible.
If FarmerBox is unable to deliver the order due to force majeure, we will look for a solution. An example is that the order, or part thereof, will be delivered at a later time. The customer is not entitled to a complaint.
FarmerBox is not liable for consequential damage.
Guarantees and complaints
FarmerBox will ensure that the products to be delivered meet the requirements that can reasonably be imposed on them.
Since the customer is responsible for the products at the time of delivery, the customer is expected to check the products for any deviations at the time of delivery.
Complaints or deviations with regard to visible defects must be made known within 24 hours via the form at https://farmerbox.nl/klantenservice/.
A complaint addressed to FarmerBox will be answered by FarmerBox within one week. FarmerBox will, if appropriate, make a compensation proposal.
Complaints with regard to part of the delivery cannot be a reason for the customer to reject the entire delivery.
The submission of a complaint does not suspend the customer's payment obligation, regardless of whether a complaint is justified.
Liability
FarmerBox is never liable to customers or third parties for damage which is wholly or partly, directly or indirectly, the result of the quality (including - but not limited to - possible infections and diseases) of the products supplied by the supplier.
The compensation by FarmerBox for any damage suffered by the customer for whatever reason, will not exceed the invoice value of the delivered goods.

Dispute settlement
Dutch law applies to all agreements to which these General Terms and Conditions relate in whole or in part.
All disputes relating to or arising from the agreement concluded between FarmerBox on the one hand and the customer on the other, to which these General Terms and Conditions apply, can only be decided by the judge of the District Court of The Hague.

FarmerBox accepts no liability for the consequences of any activities undertaken based on the information provided on this page. No obligation of FarmerBox can be derived from the content of this website, with the exception of those cases where a written agreement has been drawn up.

13.4 NIX18 - NO 18, NO ALCOHOL
Farmerbox does not provide alcoholic products to persons under the age of 18. When registering on the web shop, the customer declares to have agreed to the general terms and conditions and to meet this requirement, with which the responsibility for the correctness of this information lies with the customer.
The NIX18 campaign is an initiative of the Ministry of Health, Welfare and Sport and a large number of partners (Koninklijke Horeca Nederland, KWF cancer prevention, Lung Fund, Trimbos Institute, NOC*NSF, supermarkets united in the Central Bureau for Food Trade, GGD GHOR Nederland , GGDs, Thuiswinkel.org, the Dutch Food and Consumer Product Safety Authority and the Ministries of Security and Justice). The aim of the campaign is to strengthen the social norm 'don't drink or smoke until you are 18'. The campaign focuses on society as a whole, in particular the environment of young people. Everyone should consider it normal if young people do not smoke or drink before the age of 18.
